Pre-construction purchases of condos or houses often pose high risks. Many buyers have lost large deposits due to projects not being completed on time or at all. Developers may request mortgages on the property, delaying the transfer of ownership. Without a title, selling the property or obtaining building permits becomes challenging.
Properties in the Bahia zone are in a restricted zone and cannot be owned outright by non-citizens. A Trust with a bank as the title holder is required due to the property’s proximity to the ocean.

- Mexican residency with a Mexican tax ID shown on Telmex, CFE bills, or bank statements.
- Land size must not exceed three times the construction size in square meters.
- Exemption can only be claimed once every three years.
- Tax ID address must be different from the property being sold
- Some Notaries may require a work permit and proof of tax payments in Mexico for exemption application. Each Notary may have their own criteria for qualification.
